{"id":254831,"date":"2020-09-22T15:20:19","date_gmt":"2020-09-22T13:20:19","guid":{"rendered":"https:\/\/www.omnium.cat\/?p=254831"},"modified":"2020-09-23T13:49:47","modified_gmt":"2020-09-23T11:49:47","slug":"omnium-culturals-request-to-block-former-king-of-spain-juan-carlos-is-funds-in-switzerland-reaches-the-swiss-parliament","status":"publish","type":"post","link":"https:\/\/www.omnium.cat\/en\/omnium-culturals-request-to-block-former-king-of-spain-juan-carlos-is-funds-in-switzerland-reaches-the-swiss-parliament\/","title":{"rendered":"\u00d2mnium Cultural&#8217;s request to block former King of Spain Juan Carlos I&#8217;s funds in Switzerland reaches the Swiss Parliament"},"content":{"rendered":"\n<p>Bern, 22th September \u2013 Yesterday, <strong>MP Christian Dandr\u00e8s<\/strong>, a member Switzerland\u2019s parliament, the Assembl\u00e9e F\u00e9d\u00e9ral, <strong>presented a written parliamentary question to the Conseil F\u00e9d\u00e9ral<\/strong> (the Swiss Executive) <strong>regarding the investigations into the Swiss bank accounts of Spain\u00b4s former king, Juan Carlos I and his allegedly illicit assets in Switzerland.<\/strong> The written <strong>question was signed by Dandr\u00e8s <\/strong>(Parti Socialist) <strong>and 20 other Members of Parliament from the Parti Socialiste, Partit \u00c9cologiste and Parti du Travail<\/strong> political parties, representing a dozen different Swiss cantons.<br><br>The written <strong>question was motivated by the report that Catalonia\u00b4s NGO <\/strong><strong>\u00d2mnium Cultural<\/strong> addressed to the Swiss Government on 1 July 2020, where it called for the implementation of the \u201c<strong>Federal Act on Freezing and Restitution of Illicit Assets held by Foreign Politically Exposed Persons<\/strong>\u201d and asked that the Swiss government block the former monarch\u00b4s Swiss bank accounts pending the results of the Swiss authorities\u00b4 investigations, which allegedly were funded by illegal activities involved with corruption and money laundering.<\/p>\n<p><strong>The Swiss Government refused to block the former monarch\u00b4s funds<\/strong> on the grounds that the measures foreseen by said Act are only applicable to \u201cextraordinary situations\u201d and that the Spanish former king\u00b4s case doesn\u00b4t meet these criteria. <strong>This decision led a group of members of the Assembl\u00e9e F\u00e9d\u00e9ral to put several official questions to the Swiss Executive,<\/strong> quoting \u00d2mnium\u2019s petition to block the Juan Carlos I funds.<\/p>\n<p><strong>The questions raised are:<\/strong><\/p>\n<ol>\n<li>Is it considered \u201cnormal\u201d that a foreign Head of State makes use of Swiss financial institutions to carry out opaque financial operations with tens of millions of dollars of allegedly illicit origin?<\/li>\n<li>What steps have the Swiss federal authorities taken to determine the origin of the funds that the former King of Spain deposited in Switzerland?<\/li>\n<li>Taking into account the recent exit of the former king from Spain to a country where Switzerland has no extradition treaty or mutual assistance agreement in place, does the Federal Council have any intention to reconsider the situation and order that the former monarch\u00b4s funds in Switzerland be blocked?<\/li>\n<li>Is there any ongoing mutual aid procedure available, since the case refers to alleged infractions of potentially both Spanish and\/or Swiss tax legislation?<\/li>\n<li>Is the apparent inaction of the Swiss federal authorities compatible with Switzerland&#8217;s international commitments to the fight against corruption?<\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<p>In addition, the text mentions <strong>the alleged US$100 million fortune currently being investigated by the Geneva Prosecutor&#8217;s office for alleged corruption and money laundering<\/strong> by former King Juan Carlos I and his recent escape to the United Arab Emirates.<\/p>\n<p><strong>18 of the 21 signatories<\/strong> to the written questions are members <strong>of the Parti<\/strong><br><strong>Socialiste (Socialist Party), the second largest group in Switzerland\u00b4s<\/strong><br><strong>parliament<\/strong>, the Ass\u00e9mbl\u00e9e F\u00e9d\u00e9ral. They include Mr. Pierre Yves Maillard,<br>President of the largest trade union in Switzerland, the Union Syndical Suisse.<\/p>\n<p>For the record, <strong>Simonetta Sommaruga<\/strong>, the President
